一、前言

1.1《CHAGEE HK APP隱私政策》(以下簡稱“本隱私政策”)由香港茶姬餐飲管理有限公司(HONGKONG CHAGEE CATERING MANAGEMENT CO.LIMITED,以下簡稱“香港茶姬”或“我們”)制定,適用於CHAGEE HK APP、CHAGEE HK 微信小程式及其他衍生小程式(統稱為“霸王茶姬(香港)移動端”)、霸王茶姬香港官網(功能變數名稱為:chagee.com.hk )(以上平臺以下統稱為“霸王茶姬(香港)平臺”)。請您在使用我們提供的服務前,仔細閱讀並理解本隱私政策的全部內容。如果我們於香港境外的移動端及網站或其他第三方向您提供的服務,此等服務將受限於向您另行說明的隱私政策。

1.2請您知悉,為了給您提供更好的服務,我們會根據霸王茶姬(香港)平臺功能、服務的更新情況及法律法規的相關要求不時更新《CHAGEE HK APP隱私政策》,並就相關更新內容向您進行告知。您需理解,若您繼續使用霸王茶姬(香港)平臺,即表示您同意受到更新後的《CHAGEE HK APP隱私政策》的約束。您有權拒絕同意變更後的本隱私政策,但請您知悉,一旦您拒絕同意變更後的隱私政策,您或不能繼續完整使用霸王茶姬(香港)平臺的功能。

1.3在本隱私政策中,個人資訊將會在正文中以加粗方式標注,對此,請您重點閱讀,在確認充分理解並同意後再開始使用霸王茶姬(香港)平臺。

二、我們如何收集和使用您的個人資訊

為向您提供霸王茶姬(香港)平臺各項功能服務,我們會按照合法、正當、必要、誠信的原則收集您的個人資訊。為了確保您的個人資訊得到合理的保護,我們會嚴格遵守《個人資料(私隱)條例》(香港法例第486章),保障我們所持有的個人資料的私隱、保密性及安全。我們同樣承諾確保我們所有雇員及代理均會堅守這些責任。我們所收集及持有關於您的個人資訊包括手機號碼、頭像、昵稱、性別、生日、電子郵箱、配送地址和位置資訊,將會用於運作霸王茶姬(香港)平臺、處理您的訂單要求以及推廣活動之用。具體來說,我們僅會出於本隱私政策所述的以下目的和方式,收集和使用您的個人資訊:

2.1用戶註冊、登錄

在您註冊成為霸王茶姬(香港)平臺用戶時,您需要提供手機號碼以創建帳號。如果您不提供這些資訊,您可能無法正常使用我們的服務。目前,我們已開通全球大部分國家及地區的手機號碼,如您無法使用您所持有手機號碼登錄的,您可以通過我們的官方客服進行諮詢及瞭解。

在使用服務過程中,您可以根據您的偏好設置、修改您的頭像、昵稱、性別、生日的帳號資訊,這些將有助於我們為您提供更優質的服務體驗。但如果您不提供這些資訊,將不會影響使用霸王茶姬(香港)平臺的基本功能。

2.2會員功能與發送短信/資訊通知

當您註冊並登錄霸王茶姬(香港)平臺後,您即成為霸王茶姬會員,在您使用霸王茶姬(香港)平臺的過程中,我們會收集和使用您的會員積分、會員等級、會員經驗值、優惠券資訊、會員卡號、所在城市的會員資訊,收集上述資訊是為了向您提供相應的升級禮、生日禮等會員特權福利,並為您準備積分抽獎、積分商城、會員日等會員活動。

我們會使用您的手機號碼向您發送優惠券發放、新品推薦等短信通知,為了方便您下單後及時知曉訂單完成狀態,我們會向您帳號對應的手機號碼發送服務短信(此類短信並非行銷資訊)或通過WHATSAPP官方藍標帳號CHAGEE HK (帳號ID:+85251345521)通過WHATSAPP向您帳號對應手機號碼所對應的WHATSAPP帳號發送相關商品推薦或活動促銷等行銷資訊,但我們將同步向您提供拒絕接收前述服務短信或者行銷資訊通知的選項,如為服務短信的,您可以通過短信內容提示,隨時通過短信回復“TD”退訂,如為WHATSAPP官方藍標帳號CHAGEE HK通過WHATSAPP發送的行銷資訊,您可以通過本政策第八條與我們聯繫確認退訂行銷資訊。

請您特別注意:不論是行銷資訊還是服務短信資訊,我們都不會要求您提供任何關於您本人的資訊或帳號資訊,特別是通過WHATSAPP官方藍標帳號CHAGEE HK (帳號ID:+85251345521)所發送的行銷資訊不會以任何名義向您獲取您的任何個人資訊或者讓您支付款項,請謹慎識別消息對象。如果您選擇退訂服務短信,您將無法通過短信方式知悉您的訂單狀態,但您可以通過登錄CHAGEE HK APP-“訂單”中查詢您的訂單狀態。

2.3展示附近門店

當您使用霸王茶姬(香港)平臺服務時,我們會收集和使用您的位置資訊以便為您展示您附近的門店。如您使用的是CHAGEE HK APP,您可以通過登錄CHAGEE HK APP -“我的”-“我的功能”-“設置”-“隱私許可權”關閉該定位許可權以停止我們對您位置資訊的收集,如您使用的是CHAGEE HK小程式,您可以通過登錄CHAGEE HK小程式 -點擊右上角“●●●”-“設置”-“位置資訊”關閉該定位許可權以停止我們對您位置資訊的收集,但同時,我們向您展示附近門店的服務內容將受到影響;如您使用的是網頁版本,我們不會涉及收集和使用您的位置資訊。

2.4提供“門店自取”服務(僅限霸王茶姬(香港)移動端,網頁版本不提供此類服務)

當您使用“門店自取”的霸王茶姬(香港)移動端服務時,我們會收集您的手機號碼以通知您飲品的製作情況,並收集您的備註(口味、偏好等要求)以更好地為您製作飲品。

在提供上述服務時,我們還將收集訂單編號、您所點購的餐點或購買的商品的資訊、下單時間、支付金額和支付方式的訂單資訊,支持您查詢訂單以及向您提供客服諮詢服務。

請您注意,若您向我們提供他人的手機號碼等個人資訊的,您需確保已經就該行為取得他人的合法授權。如因您未履行前述義務導致我們承擔法律責任,我們將有權向您追償。

2.5提供“外賣點單”服務(僅限霸王茶姬(香港)移動端,網頁版本不提供此類服務)

在您使用“外賣點單”服務時,為保證您購買的商品能夠順利、安全、準確送達,我們會向為霸王茶姬(香港)移動端提供商品物流資訊系統和技術服務的第三方外賣配送公司(以下稱“配送公司”)披露訂單相關配送資訊,並由其根據商品的物流配送主體同步相關配送資訊。您知曉並同意相應配送公司不可避免地獲知及使用您的訂單資訊、收貨人姓名(名稱)、收貨地址和聯繫電話,用於完成外賣交付目的。上述配送公司您可以在附件一中查詢。

為使我們及時獲悉並確認外賣訂單的交付進度及狀態,向您提供售後與爭議解決服務,您同意我們可自配送公司處收集與交付進度相關資訊。

2.6提供“免费Wi-Fi”服務(也即“免費無線上網服務”)

目前,部分香港霸王茶姬門店(見《用戶服務協議》中的指引)提供免費Wi-Fi服務,您可開啟Wi-Fi功能並選擇指定的網路名稱(SSID) (見《用戶服務協議》中的指引)後,於您的電腦或手機上開啟流覽器,輸入您的手機號及驗證碼後進行登錄上網。您知晓并同意相应无线网络运营商(定義詳見《用戶服務協議》)不可避免地获知及使用您的手機號碼,用于完成無線上網服務之目的,同時還可能要求您就使用無線上網服務接受一些條款和條件,屆時需您仔細閱讀並同意相關服務協議(包括隱私政策)。上述无线网络运营商您可以在附件一中查询。

2.7開具帳單

當您使用開具帳單功能時,我們會收集您的姓名、開票金額、電子郵箱、手機號碼,用於為您開具帳單並在開具成功後向您發送提醒和電子帳單,如您需要,您可以發送電子郵件至customercare_hk@chagee.com與我們的客服取得聯繫。

2.8抽獎活動

當您參與我們的抽獎活動時,我們會收集您的手機號碼,用於為您發放免單券、優惠券或折扣券的獎品,如抽獎活動中存在實體商品的,我們還有可能會收集您的收貨地址、門牌號以向您提供獎品配送服務,在此情況下,我們會再次通過顯著方式獲取您的同意。

2.9提供客服功能

當您使用霸王茶姬(香港)移動端時,為了向您提供客服服務,解決關於退款、優惠券使用、門店聯繫、開具帳單與加盟等問題,我們將收集您的問題描述等諮詢內容。

為保證您的帳號安全,我們的客服可能會使用您的姓名、地址與聯繫電話核驗您的身份。當您需要我們提供與您訂單資訊相關的客服與售後服務時,我們將會查詢您的訂單資訊。您有可能會在與我們的客服人員溝通時提供上述資訊外的其他資訊,如您要求我們變更配送資訊時,您需要向我們提供配送地址、聯繫人和聯繫電話。

請注意,如您需要我們提供客服服務,您可以發送電子郵件至customercare_hk@chagee.com與我們的客服取得聯繫。

2.10安全支持

在您使用我們服務過程中,為保障您的帳戶安全,識別帳戶異常狀態、瞭解產品適配性,保障向您提供服務的安全穩定運行,在您使用我們的產品/服務過程中,經您授權我們會獲取您的設備資訊,包括設備設置、用戶識別資訊、及其他與我們服務相關的服務日誌資訊,包括流覽記錄、訂單資訊、IP地址、訪問日期和時間。

為提高您使用我們提供的服務的安全性,更準確地預防釣魚網站欺詐和木馬病毒,我們可能會使用或整合您的個人資訊以及我們合作夥伴取得您授權共用的資訊(具體合作夥伴及授權共用的資訊見附件),根據您的使用習慣和常用軟體資訊等來綜合判斷您的帳號及交易風險,包括驗證身份,預防、發現和調查可能存在的欺詐、網路病毒、網路攻擊等安全風險以及違反我們或關聯方協議政策或規則等行為,以保護您或其他用戶以及我們或關聯方的合法權益,並記錄一些我們認為有風險的鏈接(“URL”)。

2.11設備許可權獲取說明

您理解並同意我們提供的產品/服務可能需要您在您的設備中開啟您的設備資訊、位置資訊、相冊的訪問許可權,以實現這些許可權所涉及資訊的收集和使用。您可在您的設備設置查看上述許可權的狀態並可自行決定這些許可權的開啟或關閉。

設備資訊:當您啟動霸王茶姬(香港)移動端我們可能會向您申請獲取此許可權,目的是為了安全風控。當需要讀取您的設備資訊時,如果您選擇不開啟此許可權,您可以使用我們提供的其他服務,但可能無法完成安全風險驗證。前述設備資訊是指設備識別字、軟體產品版本號等。

位置:當您搜索霸王茶姬門店、使用基於所在地點位置的服務、參加展示互動活動時,我們可能會向您申請獲取此許可權,目的是為您提供相應的服務。如您選擇不開啟位置許可權,您將無法使用基於所在地點位置的相應服務,也無法參加基於所在地點位置的活動,但不影響您使用我們提供的其他服務。

相冊:當您需要更換您個人資料的頭像時,需要開啟相冊許可權,如您不開啟相應許可權,將無法使用該特定功能,但不影響您使用我們提供的其他服務。

1)您開啟任一許可權即代表您授權我們可以收集和使用相關個人資訊來為您提供對應的服務,您一旦關閉任一許可權即代表您取消了授權,我們將不再基於對應許可權繼續收集和使用相關個人資訊,也無法為您提供該許可權所對應的服務。但是,您關閉許可權的決定不會影響此前基於您的授權所進行的個人資訊收集及使用。

2)在不同設備的霸王茶姬(香港)移動端中,因設備系統及我們所提供服務的差異,我們向您獲取的許可權以及告知方式略有不同,具體請您參考相應的頁面提示。在不同設備中許可權的顯示方式及關閉方式可能有所不同,具體請您參考設備及系統開發方說明或指引。

2.12網站Cookie:每次您訪問我們的網站或在我們和第三方網站和服務上接收我們的行銷傳播和廣告並進行交互時,我們可能會自動通過Cookie(存放在硬碟上的小型資訊檔)、網路信標、跟蹤像素、流覽器配置詳細資訊(例如流覽器類型、已安裝插件列表和已安裝字體列表)以及嵌入式腳本(暫時下載到設備上的編程代碼)在您控制的網路、電子郵件或廣告和行銷伺服器上記錄您的活動。

2.13其他資訊

我們向您提供的功能和服務是不斷更新和發展的,如果某一功能或服務未在前述說明中且收集了您的個人資訊,我們會通過頁面提示交互流程、網站公告等方式另行向您告知我們另外收集的個人資訊類型、範圍和目的,並征得您的同意。

另外,根據相關法律法規及法庭判令,在以下情況下,我們無需取得您進一步的授權同意即可收集和使用您的個人資訊:

1)根據所有相關法律或法庭判令的要求或其他政府或執法機構的要求

2)與公共安全公共衛生公眾知情等重大公共利益直接相關的;

3)與犯罪偵查、起訴、審判和判決執行等直接相關的;

4)為確立法律申訴或辯護、獲取法律意見;

5)出於維護個人資訊主體或其他個人的生命財產聲譽等重大合法權益但又很難得到本人同意的;

6)所收集的個人資訊是個人資訊主體自行向社會公眾公開的;

7)從合法公開披露的資訊中收集的您的個人資訊的,如合法的新聞報導、政府資訊公開等管道;

8)根據您要求簽訂和履行合同所必需的;

9)用於維護所提供的產品或服務的安全穩定運行所必需的,例如發現處置產品或服務的故障;或

10)法律法規規定的其他情形。

三、我們如何對外提供、轉讓、公開披露與委託處理您的個人資訊

3.1業務共用

在下列情況下我們將會共用您的個人資訊:

為了向您提供更完善優質的產品和服務,以提供更好的客戶服務和用戶體驗,我們的某些服務將由授權合作夥伴提供。在此情況下,我們可能會將您的個人資訊轉移至並披露予第三方並與該等授權合作夥伴共用個人資訊的場景與相關個人資訊處理情況請參考附件一《第三方共用個人資訊清單》,目前官方網站不涉及個人資訊共用。

3.2第三方SDK共用

為確保為您提供的部分功能和服務的實現,我們會在霸王茶姬(香港)平臺中嵌入第三方的SDK。有關SDK處理個人資訊的目的、方式及範圍等資訊,請查看附件二《第三方SDK共用清單(適用於CHAGEE HK APP)》、附件三《第三方SDK共用清單(適用於CHAGEE HK 微信小程式)》,目前官方網站不涉及第三方SDK共用。我們僅會出於合法、正當、必要、特定明確的目的共用您的個人資訊,並且只會共用提供服務所必要的個人資訊。同時,我們會與合作夥伴簽署嚴格的保密協定,要求他們按照我們的說明、本隱私政策以及其他任何相關的保密和安全措施來處理您的個人資訊。如果您拒絕我們的合作夥伴在提供服務時收集為提供該服務所必需的個人資訊,將可能導致您無法在我們的霸王茶姬(香港)平臺中使用該第三方服務。

3.3轉讓資訊

我們不會將您的個人資訊轉讓給任何公司、組織和個人,但以下情況除外:

1)事先獲得您的明確同意;

2)根據法律法規或強制性的行政或司法要求;

3)在涉及資產轉讓收購兼併重組或破產清算時,如涉及到個人資訊轉讓,我們會向您告知有關情況並要求新的持有您個人資訊的公司、組織繼續受本隱私政策的約束,如變更個人資訊使用目的時,我們將要求該公司、組織重新取得您的明確同意。

3.4公開披露

我們僅會在以下情況下,公開披露您的個人資訊:

1)除在公佈中獎活動名單時會脫敏展示中獎者昵稱外,原則上我們不會將您的資訊進行公開披露。如確需公開披露時,我們會向您告知公開披露的目的、披露資訊的類型及可能涉及的敏感個人資訊,並征得您的明確事先同意;

2)基於法律的披露:在法律程式訴訟或政府主管部門強制性要求的情況下,我們可能會公開披露您的個人資訊;

3)因需要對違規帳號欺詐行為等進行處罰公告的(惟僅會披露您的帳戶昵稱)。

特別提示:對於公開披露的您的個人資訊,我們會在收到公開披露申請後第一時間審慎審查其正當性、合理性、合法性,並在公開披露時和公開披露後採取最嚴格個人資訊安全保護措施和手段對其進行保護。

3.5委託處理

為了進行產品推廣、提升資訊處理效率、降低資訊處理成本或提高資訊處理準確性,我們可能會委託我們在不同法域的關聯公司或其他合作夥伴代表我們來處理您的資訊。我們會通過書面協議等方式要求受託方按照約定的目的、方式和範圍來處理您的個人資訊,以及遵守嚴格的保密義務及採取有效的資訊安全保密措施,禁止其將這些資訊用於其他未經我們與您授權的用途。因此,您的個人資訊有可能或被轉移至不同法域。

四、我們如何保護您的個人資訊

4.1為保障您的資訊安全,我們在收集您的個人資訊後,在符合任何法律、法定、規管或會計規定的情況下,我們會以適當的方式保存您提供的個人資訊,並將採取各種合理必要的措施保護您的個人資訊。

4.2我們致力於使用各種安全技術及配套的管理體系來儘量降低您的資訊被洩露、毀損、誤用、非授權訪問、非授權披露和更改的風險。例如:通過網路安全層軟體進行加密傳輸、資訊加密存儲、嚴格控制數據中心的訪問。傳輸和存儲敏感個人資訊時,我們將採用加密、許可權控制、去標識化等安全措施。

4.3我們設立了資訊安全部門,針對個人資訊收集、使用、共用處理等進行合規管理。同時,我們採用了恰當的技術措施和組織設置(包括加密分級及許可權管理)以保護您的個人資訊安全,並定期開展培訓和審計確保有專門的且適格的崗位和人員保護您的個人資訊。

4.4我們會採取一切合理可行的措施確保不會收集無關的個人資訊。我們只會在達成本隱私政策所述目的所需的必要期限內保留您的個人資訊,除非延長保留期受到法律法規的允許。

4.5互聯網並非絕對安全的環境。因此,我們強烈建議您採取積極措施保護個人資訊的安全,包括但不限於使用複雜密碼、定期修改密碼、不將自己的帳號密碼等個人資訊透露給他人。如您發現自己的個人資訊尤其是您的帳戶或密碼發生洩露,請您立即聯絡客服,以便我們根據您的申請採取相應措施。

4.6在您終止使用我們的服務後,我們會停止對您的個人資訊的收集和使用,法律法規或監管部門另有規定的除外。如我們停止服務或運營,我們會至少提前三十日向您通知,並在終止服務或運營後對您的個人資訊進行刪除或匿名化處理。

4.7在不幸發生個人資訊安全事件後,我們將遵從法律法規規定及政府監管的要求,及時向您告知:安全事件的基本情況和可能的影響、我們已採取或將要採取的處置措施、您可自主防範和降低風險的建議、對您的補救措施等,我們將及時將事件相關情況以郵件信函電話等方式告知您,難以逐一告知個人資訊主體時,我們會採取合理有效的方式發佈公告。同時,我們還將按照相關監管部門要求,在遵從法律法規規定的前提下主動上報個人資訊安全事件的處置情況。

4.8如所有的企業都可能面臨的問題一樣,考慮到資訊技術網路空間本身的特點,在某些特殊情況下(例如駭客攻擊、電信故障等),儘管我們採取了法律法規等規定的必要的措施,但仍存在個人資訊洩露的風險。除非本隱私政策有其他規定為了保護您的人身或財產安全,我們特別提示您不要通過公共網路,向我們或任何以我們名義為您提供服務的第三方,提供您的財產狀況、健康生理、帳戶密碼或驗證碼、通信內容等涉及您人身或財產安全的敏感個人資訊。

五、您的權利

我們非常重視您對個人資訊的關注並盡全力保護您對於您個人資訊訪問、更正、刪除以及撤回同意的權益,以使您擁有充分的能力保障您的隱私和安全。您的權利包括:

①登錄CHAGEE HK APP-“我的”-點擊“頭像”、“昵稱”、“性別”、“生日”進行資訊查詢和修改;

②登錄CHAGEE HK 小程式-“我的”-點擊“昵稱”進入“個人資料”-點擊“頭像”、“昵稱”、“性別”、“生日”進行資訊查詢和修改。

5.1.1.2您可以通過以下路徑查閱、更正和補充您的收貨資訊(包括收貨地址、收貨人姓名(名稱)、電話):

①登錄CHAGEE HK APP-“首頁”-點擊“外賣點單”-“收貨地址”-“請選擇收貨地址”-點擊頁面下方“新增地址”,即可新增您的收貨資訊;

登錄CHAGEE HK APP-“首頁”-點擊“外賣點單”-“收貨地址”-“請選擇收貨地址”-點擊“我的收貨地址”下方您已輸入地址後面的“鉛筆”圖樣,即可修改您的收貨資訊;

登錄CHAGEE HK APP-“首頁”-點擊“外賣點單”-“收貨地址”-“請選擇收貨地址”-點擊“我的收貨地址”下方您已輸入地址後面的“鉛筆”圖樣-點擊“刪除地址”即可刪除您已輸入的收貨資訊;

②登錄CHAGEE HK 小程式-“首頁”-點擊“外賣點單”-“收貨地址”-“請選擇收貨地址”-點擊頁面下方“新增地址”,即可新增您的收貨資訊;

登錄CHAGEE HK 小程式-“首頁”-點擊“外賣點單”-“收貨地址”-“請選擇收貨地址”-點擊“我的收貨地址”下方您已輸入地址後面的“鉛筆”圖樣,即可修改您的收貨資訊;

登錄CHAGEE HK 小程式-“首頁”-點擊“外賣點單”-“收貨地址”-“請選擇收貨地址”-點擊“我的收貨地址”下方您已輸入地址後面的“鉛筆”圖樣-點擊“刪除地址”即可刪除您已輸入的收貨資訊;

若您無法通過上述路徑查閱該等個人資訊或是想查閱、更正和補充其他個人資訊,您可以通過本政策第八條“聯繫我們”取得聯繫,我們將在15個工作日內回復您的訪問請求。

5.1.2對於您在行使上述權利過程中遇到的困難,或者其他可能目前無法向您提供線上自行更正/修改服務的,經過對您身份的驗證,且更正/修改不影響資訊的客觀性和準確性的情況下,您有權對錯誤或不完整的資訊作出更正或修改,或在特定情況下,尤其是數據錯誤時,通過我們公佈的回饋與報錯等措施將您的更正/修改申請提交給我們,要求我們更正或修改您的數據,但法律法規另有規定的除外。出於安全性和身份識別的考慮或者技術手段原因,您可能無法修改註冊時提交的某些初始註冊資訊(如您註冊後系統自動生成的會員ID號等),前述初始註冊資訊並非對外展示資訊,也不會對您使用有任何影響,在此種情況下,如果您需要,我們可以刪除您的帳戶讓您能夠通過重新註冊帳戶的方式來修改您的資訊,但請注意,此做法您將失去原有帳戶的所有資訊。

5.2刪除您的個人資訊

您可以通過本隱私政策“八、聯繫我們”中的聯繫方式向我們提出刪除個人資訊的請求。

在我們收到您的刪除請求,我們將同時盡可能通知從我們處獲得您的個人資訊的主體,要求其及時刪除,除非法律法規另有規定,或這些主體獲得您的獨立授權。

當您或我們協助您從我們的服務中刪除資訊後,依據相關法律法規的規定,我們可能不會立即從備份系統中刪除相應的資訊,我們將安全地存儲您的個人資訊並將其與任何進一步處理隔離,直到備份可以刪除或實現匿名化處理。

5.3註銷您的帳號

1)如需註銷帳號,您可以通過登錄CHAGEE HK APP-點擊“我的”-點擊“許可權設置”-“註銷帳號”或CHAGEE HK 小程式-點擊“我的”-點擊“帳戶名稱”-進入“個人資料”-點擊“帳號與安全”申請註銷;您也可以通過提交電子郵件至customercare_hk@chagee.com申請註銷。

2)請您特別注意,關於您註銷帳號的方式以及您應滿足的條件,請詳見本隱私政策附件四《帳號註銷須知》。您註銷帳號後,我們將停止為您提供產品與/或服務,並依據您的要求,除法律法規另有規定外,我們將刪除您的個人資訊或對您的個人資訊進行去標識化處理。

5.4撤回您對個人資訊的同意

我們提供的產品和服務的部分功能需要獲得您使用設備的相關許可權(包括位置、相冊等,具體以產品實際獲取的功能為准),您可以在授權後隨時撤回(或停止)對該許可權的繼續授權。您可以通過刪除資訊、更改隱私設置、在系統中關閉設備許可權功能等方式改變您授權我們繼續收集個人資訊的範圍或撤回您的授權。具體方法如下:提交電子郵件至customercare_hk@chagee.com申請撤回您的授權。

當然,您也可以通過選擇註銷帳號的方式,撤回我們繼續收集您個人資訊的全部授權。您需理解,當您撤回授權後,我們無法繼續為您提供授權所對應的特定功能和/或服務。但您撤回授權的決定不會影響此前基於您的授權而開展的個人資訊處理。

5.5回應您的其他權利請求

5.5.1如果您需要但無法通過上述方式查閱、更正或刪除您的個人資訊的,或您需要查閱、更正或刪除您在使用我們產品與/或服務時所產生的其他個人資訊,或您需要行使您在相關法律法規下所具有的其他個人資訊權利(例如索取有關您個人資料的副本)的,您均可以通過本隱私政策第八條“聯繫我們”公示的聯繫方式與我們聯繫。

為了保障安全,我們可能需要您提供書面請求,或以其他方式證明您的身份,我們將在收到您回饋並驗證您的身份後的30日內答復您的請求。對於無端重複,需要過多技術手段(例如,需要開發新系統或從根本上改變現行慣例)、給他人合法權益帶來風險或者非常不切實際的請求,我們可能會予以拒絕。

5.5.2在以下情形中,按照法律法規要求,我們將無法回應您的請求:

1) 根據所有相關法律或法庭判令的要求或其他政府或執法機構的要求;

2)與公共安全、公共衛生、重大公共利益有關的;

3)與犯罪偵查、起訴、審判和執行判決等有關的;

4) 為確立法律申訴或辯護、獲取法律意見

六、我們如何存儲您的個人資訊

6.1資訊存儲的地點

6.1.1我們的服務是全球性的,資訊可能會在必要情況下,按照適用法要求在我們業務範圍的國家/地區以及我們與服務提供商合作的國家/地區進行存儲和處理(包括來自其他司法管轄區的訪問等)。您知悉並確認,前述我們對您個人資訊的處理活動均系為您提供服務所必須的處理活動,如您不同意我們按照前述方式方式、處理您的個人資訊,您可能無法使用我們的全部功能。

6.1.2我們將會嚴格遵守《個人資料(私隱)條例》(香港法例第486章)的要求,在取得您同意或具備其他合法性基礎的前提上進行前述個人資訊跨境傳輸。您可以通過本隱私政策第八條的指引聯繫我們瞭解相關境外合作方名稱、聯繫方式、處理目的、處理方式、個人資訊種類及您行使個人資訊權利的方式和程式等情況。我們會依據《個人資料(私隱)條例》(香港法例第486章)的要求,評估個人資訊跨境傳輸的合法性、正當性以及必要性,並督促我們的境外合作方按照《個人資料(私隱)條例》(香港法例第486章)、相關協議的約定來處理您提供的個人資訊。這些管轄區可能具有與香港不同的資訊保護規則,包括向監管機構傳輸資訊,或傳輸給在香港境外運營的、代表我們或我們的供應商處理資訊的員工,員工可能從事履行您的要求並提供支持服務的業務。但是,我們將採取措施確保任何此類傳輸符合可適用的資訊保護法律,並確保對您的資訊保護符合本隱私政策中描述的標準。通過提交資訊,即表示您同意共用、存儲或處理。我們將採取合理必要的一切步驟,確保資訊得到安全處理,並符合本隱私政策和相關資訊保護規定。

6.1.3我們只會在達成本隱私政策所述目的所需的期限內保留您的個人資訊。 我們將嚴格落實您的個人資訊存儲期限最小必要原則,比如,按照反洗錢法律法規的要求在業務關係結束後存儲您的個人資訊至少五年。如相關數據不再具有存儲使用必要及法律限制的,我們將及時採取數據刪除或者匿名化處理措施。

6.2資訊存儲的期限

6.2.1我們對您個人資訊的保存期限為實現相關處理目的所必要的最短時間。一般而言,我們在您使用霸王茶姬(香港)平臺服務期間持續存儲您的個人資訊,並在您註銷帳戶後刪除或匿名化處理您的個人資訊,但如按照反洗錢法律法規的要求我們需在業務關係結束後存儲您的個人資訊至少五年的,我們會嚴格遵守此類最小必要原則進行存儲。如相關數據不再具有存儲使用必要及法律限制的,我們將及時採取數據刪除或者匿名化處理措施。

6.2.2當我們的產品或服務發生停止運營的情形時,我們將提前以推送通知、公告等形式通知您,並在停止運營後刪除您的個人資訊或進行匿名化處理。

七、我們如何保護未成年人的個人資訊

7.1因為我們僅以手機號碼識別香港茶姬會員,且不收集您的任何與身份證件相關的資訊,因而我們無法辨別用戶是否為未成年人。如果您屬於所在司法轄區所定義的未成年人,在使用我們的霸王茶姬(香港)平臺前,煩請您務必讓您的監護人仔細閱讀本隱私政策條款,並在征得您的監護人同意的前提下使用霸王茶姬(香港)平臺以及向我們提供您的個人資訊。如您的監護人不同意您按照本隱私政策條款使用我們的霸王茶姬(香港)平臺的,或者您發現我們存在收集未成年人個人資訊的情況的,請您立即終止使用我們的服務或及時通知我們,以便我們採取相應的措施,包括但不限於刪除您的個人資訊等。關於未成年人的年齡限制,我們將遵循您所在司法轄區規範,並將隨法律變化動態調整。

7.2如您為未成年人的監護人,當您對您所監護的未成年人的個人資訊處理存在疑問時,請通過本政策條款所公示的聯繫方式聯繫我們,以便我們及時採取相應的措施。

7.3如果霸王茶姬(香港)平臺在特定功能下涉及向未成年人提供服務的,我們將提醒相關監護人在為未成年人報名參加活動或購買此類服務時需認真閱讀本隱私政策和我們的其他告知文本,監護人主動報名或購買此類服務,即代表監護人明確同意我們收集使用相關未成年人個人資訊。

十、爭議解決

10.1除您及霸王茶姬外,並無其他人士有權按《合約(第三者權利)條例》(香港法例第623章)強制執行本隱私政策及相關附件的任何條文,或享有本隱私政策及相關附件的利益。

10.2本隱私政策以中文簡體、中文繁體、英文書寫,如中文版本與英文版本存在任何表述歧義或衝突,均以中文版本的解釋和表述為准。

10.3本隱私政策的解釋及爭議解決均應適用中國香港特別行政區之法律,香港法院對任何因本隱私政策及相關附件所引起的爭議享有獨有的司法管轄權。

10.4如果您認為我們處理個人資訊的行為損害了您的合法權益您也可以選擇向中國香港當地政府部門進行反映。

2.您知曉並同意,香港茶姬會員帳號一旦被註銷將不可恢復,請您在操作之前自行備份香港茶姬會員帳號相關的所有資訊和數據。請您保存好訂單商品和服務的交易憑證、票據等資料,否則您有可能須支付額外的帳號和訂單查詢費用,或無法享受售後服務。

3.如果您的香港茶姬會員帳號涉及爭議糾紛,包括但不限於投訴、舉報、訴訟、仲裁、國家有權機關調查

等,我們有權自行終止香港茶姬會員帳號的註銷而無需另行得到您的同意。

4.在您完成註銷香港茶姬會員帳號確認程式後,我們將同步終止為您提供《用戶服務協議》(簡稱為“用戶協議”)中約定的服務、我們所發佈的其他制度或規定中的服務、政策、制度、規定以及第三方平臺通過香港茶姬所發佈的服務、任務等,用戶協議、政策、制度、規定以及第三方平臺通過香港茶姬平臺所發佈的服務、任務等中所約定的雙方權利義務均在您完成註銷程式後終止(但依用戶協議、政策、制度、規定等條款中另行約定不得終止的或者依據其性質不能終止的除外)。您的帳號即同步被註銷,您將無法再使用香港茶姬會員帳號,也將無法找回您香港茶姬會員帳號中及與帳號相關的任何內容或資訊,包括但不限於:

(3)您曾獲得的相關帳號權益(包括但不限於會員積分、會員等級等)等視為您自行放棄,將無法繼續使用。

1.1 CHAGEE HK APP Privacy Policy (“This Privacy Policy”) was formulated by HONG KONG CHAGEE CATERING MANAGEMENT CO. If our mobile clients and websites or other third parties outside Hong Kong provide services to you, such services will be subject to the privacy policy explained to you separately. 

1.2 Please be aware that in order to provide better services to you, we will update “CHAGEE HK APP Privacy Policy” from time to time according to updated functions and services of CHAGEE (Hong Kong) Platforms and relevant requirements of laws and regulations, and inform you of relevant updates. You are required to understand that you agree to be bound by the updated “CHAGEE HK APP Privacy Policy” if you continue using CHAGEE (Hong Kong) Platforms. You have the right to refuse to agree with this Privacy Policy after change, but please be aware that once you refuse to agree with the updated privacy policy, you might be unable to continue using any functions of CHAGEE (Hong Kong) Platforms in entirety. 

1.3 In this Privacy Policy, personal information will be marked in bold in the text, with respect to which you are requested to particularly read and confirm full understanding and agree before starting to use CHAGEE (Hong Kong) Platforms. 

II. How We Collect and Use Your Personal Information

In order to provide various functions and services of CHAGEE (Hong Kong) Platforms to you, we will collect your personal information following the principles of lawfulness, legitimacy, necessity and good faith. To ensure your personal information is reasonably protected, we will safeguard the privacy, confidentiality and security of personal data and information we hold strictly in compliance with the Personal Data (Privacy) Ordinance (Cap. 486). We likewise undertake to ensure any and all of our employees and agents will adhere to these responsibilities. Personal information we collect and hold about you include mobile number, avatar, nickname, sex, birthday, email address, ship-to address and location information, which will be used to operate CHAGEE (Hong Kong) Platforms, process your order requirements and for promotional events and activities. Specifically, we will collect and use your personal information only for the following purposes and in the following manners as set forth herein: 

2.1 User registration and login 

When you register to become a user of CHAGEE (Hong Kong) Platforms, you need to provide your mobile number in order to create an account. If you don’t provide that information, you might be unable to use our services normally. At present, we have enabled mobile numbers in most of countries and regions worldwide, and if you are unable to log in using your mobile number, you can consult through our official customer service for more information.

While using the services, you can set and modify your account information such as avatar, nickname, sex and birthday according to your preference, which will help us provide higher-quality service experience to you. But if you don’t provide these pieces of information, it will not affect your use of basic functions of CHAGEE (Hong Kong) Platforms. 

2.2 User functions and sending text messages/information notifications

Once you register and log into CHAGEE (Hong Kong) Platforms, you become a CHAGEE user, and while you use CHAGEE (Hong Kong) Platforms, we will collect and use your User information such as user bonus points, user grade, user experience value, coupon information, User card number and city of your presence, so as to provide you with corresponding upgraded gifts, birthday gift and other user-privileged benefits and prepare Userevents for you such as point-based raffle, bonus point mall and User day. 

We will use your mobile number to send text message notices to you such as coupon distribution and new product recommendation, and in order for you to know the status of order completion promptly after placing an order, we will send service text messages (such text messages are not marketing information) to the mobile number corresponding to your account or send marketing information such as relevant commodity recommendations or promotional events to the WHATSAPP account corresponding to the mobile number corresponding to your account through WHATSAPP official blue-tag account CHAGEE HK (account ID: +85251345521) and via WHATSAPP, but we will synchronously provide you with an opt-out option to refuse to receive the aforesaid service text messages or marketing information notices by replying “TD” via text message at any time through text message prompt in case of service text messages or by contacting us to confirm opt-out of marketing information according to Article 8 hereof in case of marketing information sent through WHATSAPP from WHATSAPP official blue-tag account CHAGEE HK. 

Please particularly note that, be it marketing information or service text message, we will not require you to provide any information about yourself or account information, especially that the marketing information sent via WHATSAPP official blue-tag account CHAGEE HK (account ID: +85251345521) will not acquire any of your personal information from you or ask you to make any payment in any name, o please be cautious to identify the subject of messages. If you chose to opt out of service text messages, you will be unable to know your order status via text message, but you can query your order status by logging into CHAGEE HK APP-“orders”. 

2.3 Display of nearby stores

When you are using any service of CHAGEE (Hong Kong) Platforms, we will collect and u se your location information in order to show you the nearby stores. If you are using CHAGEE HK APP, you can disable the locating permissions by logging into CHAGEE HK APP -“My”-“My functions”-“settings”-“privacy permissions” in order to stop our collection of your location information, while if you are using CHAGEE HK WeChat Mini-program, you can do so by logging into CHAGEE HK WeChat Mini-program -click “●●●” on the upper right corner—“settings”—“location information”, but in the meantime the service contents with which we show you nearby stores will be adversely affected; if you are using the web version, we will not be involved in collecting or using your location information. 

2.4 Providing “store self-pickup” service (limited to CHAGEE (Hong Kong) mobile clients, not provided by the web version)

When you are using CHAGEE HK mobile client service of “store self-pickup”, we will collect your mobile number in order to notify you of the status of drink making and collect your remarks (taste, preference and other requirements) in order to better make drinks for you. 

When providing the aforesaid services, we will also collect order information such as order number, information about foods ordered or commodities purchased by you, time of placing an order, amount paid and payment method, so as to support you to query orders and provide customer service consulting services to you. 

Please note that if you provide personal information of others such as mobile number to us, are need to ensure that you have acquired lawful authorization from others with respect to such act. If you failed to perform the aforesaid obligations, causing us to be legally liable, we will have the right to recover the resulting losses from you. 

2.5 Providing “takeout ordering” service (limited to CHAGEE (Hong Kong) mobile clients, not provided by the web version)

When you are using the “takeout ordering” service, to ensure the commodities you purchased will be delivered smoothly, safely and accurately, we will disclose order-related delivery information to third-party takeout delivery companies providing commodity logistics information systems and technical services to CHAGEE (Hong Kong) mobile clients (“Delivery Companies”) and have them synchronize relevant delivery information according to the person responsible for logistics and delivery of commodities. You are aware and agree that delivery companies will inevitably access and use your order information, consignee name, ship-to address and contact telephone number for the purposes of completing takeout delivery. The aforesaid delivery companies can be found in Annex I hereto. 

In order for us to keep informed of and confirm the delivery progress and status of takeout orders, and provide you with after-sales and dispute resolution services, you agree that we may collect information related to delivery progress from delivery companies.

2.6 Providing “free Wi-Fi” service (i.e., “free wireless internet access service”)

Currently, some of CHAGEE HK stores (see the guide in the Terms and Conditions) provide free Wi-Fi service, so you can log into the internet by opening the browser on your computer or mobile phone and inputting your mobile number and verification code after enabling the Wi-Fi function and selecting the designated network name (SSID) (see the guide in the Terms and Conditions) . You are aware and agree that corresponding wireless network operators (as defined in the Terms and Conditions) will inevitably access and use your mobile number for the purposes of completing wireless internet access services and might at the same time require you to accept certain terms and conditions on use of wireless internet access service, at which time you are required to carefully read and agree to relevant service agreements (including privacy policy). The aforesaid wireless network operators can be found in Annex I hereto. 

2.7 Issuing bills

When you are using the billing function, we will collect your name, billed amount, e-mail address and mobile number for using bills to you and sending you reminders and e-bills to you after successful issuing, for which you can contact our customer service by emailing to customercare_hk@chagee.com if desired. 

2.8 Raffles 

When you are participating in our raffles, we will collect your mobile number for issuing prizes such as free coupons, coupons or discount coupons, and we might also collect your ship-to address and street number in order to provide prize delivery service to you if physical commodities are involved in raffles, in which case we will once again acquire your consent in a conspicuous manner. 

2.9 Providing customer service functions

When you are using CHAGEE (Hong Kong) mobile clients, in order to provide you with customer care service and resolve issues and problems such as refund, coupon use, store contacting, bill issue and franchising, we will collect your consulting contents such as problem description.

In order to guarantee your account security, our customer service might verify your identity using your name, address and telephone number. When you need us to provide customer service and after-sales services related to your order information, we will query your order information. You might have provided other information beyond the aforesaid information when communicating with our customer service personnel, so you need to provide us with the delivery address, contact person and telephone number when and if you require us to change the delivery information.

2.10 Security support 

While you are using our services, in order to ensure your account security, identify account abnormalities, understand product adaptability, and assure the secure and stable operation of services provided to you, in the process of you using our products/services, subject to your authorization, we will acquire your device information, including device settings, user identification information and other service log information related to our services, including browsing records, order information, IP address, and date and time of access. 

In order to increase the security of your use of services provided by us and prevent phishing site fraud and Trojan virus more accurately, we might use or integrate your personal information and information shared by our partners under your authority (see the annex for specific partners and information shared with authorization), and judge risks to your account and transactions comprehensively based on your habit of use and commonly-used software information, including authenticating, preventing, discovering and investigating possible security risks such as fraud, internet virus and cyber attack and violations of agreements, policies or rules of us or our affiliates, so as to protect the legitimate rights and interests of you or other users and us or our affiliates, and record some links (“URL”)we deem risky.

2.11 Notes on acquisition of device permissions

You understand and agree that products/services provided by us might require you to enable access to your device information, location information and album in your device in order to achieve collection and use of information involved in these permissions. You can view the status of the aforesaid permissions in your device settings and determine the on or off of these permissions at your sole discretion. 

Device information:When you start CHAGEE (Hong Kong) mobile clients, we might apply to you for this access for the purposes of security risk control. When your device information is required to be read, if you choose not to enable that access, you can use other services provided by us, but might be unable to complete security risk verification. The aforesaid device information refers to device identifier and software product version number, etc. 

Location:When you are searching a CHAGEE store, using any service based on your location or participating in display and interactive activities, we might apply to you for this access for the purposes of providing the corresponding services to you. If you choose not to enable location permissions, you will be unable to use any corresponding service based on your location or participate in any activities or events based on your location, but without affecting your use of other services provided by us. 

Album: When you need to replace the avatar of your personal profile, you need to enable the album permissions, which, if not enabled by you, will render you unable to use this specific function, but without affecting your use of other services provided by us. 

1) By enabling any permission, you authorize us to collect and use relevant personal information to provide corresponding services to you, and by disabling any permission, you cancel your authorization, and we will no longer collect and use relevant personal information based on corresponding permission, nor can we provide to you any services corresponding to that permission. However, your decision to disable any permissions will not affect the previous collection or use of personal information based on your authorization. 

2) Among CHAGEE (Hong Kong) mobile clients on different devices, due to the difference in device system and services we provide, the permissions we acquired from you and how we inform you thereof are slightly different, so please refer to the corresponding page prompts for details. How permissions are displayed and turned off in different devices might be somewhat different, so please refer to the instructions or guidance from the device and system developers for details. 

2.12 Website Cookie: Every time you access our website or receive our marketing communications and ads and interact on our and third-party websites and services, we might automatically record your activities on the network, email or advertising and marketing servers controlled by you through Cookie (small information file stored on hard drive), web beacon, tracking pixels, browser configuration details (such as browser type, installed plug-ins list and installed font list) and embedded script (programming codes temporarily downloaded to devices). 

2.13 Other information 

Functions and services provided by us to you continuously update and evolve, such that if a particular function or service is outside of the aforesaid notes and collected your personal information, we will inform you of the type, scope and purpose of personal information we otherwise collected separately via page prompt interaction process, website announcement or otherwise, and obtain your consent. 

In addition, according to relevant laws and regulations and court orders, in the following circumstances, we may collect and use your personal information without your further authorization or consent: 

1)Pursuant to requirements of all relevant laws or court orders or of other governments or law enforcement agencies;

2) Directly in connection with significant public interests such as public security, public health and public’s right to know; 

3) Directly in connection with crime investigation, legal action, trial and judgment execution; 

4) To establish legal appeal or defense or acquire legal opinion; 

5) As needed to safeguard significant legitimate rights and interests of the personal information subject or other individuals such as life, properties and reputation, but highly difficult to obtain the consent of the person concerned; 

6) Personal information collected is made public to the general public by the personal information subject; 

7) Your personal information collected from lawfully and publicly disclosed information, such as lawful news coverage, government information disclosure and other channels; 

8) As necessary for execution and performance of contracts upon your request; 

9) As necessary to maintain the safe and stable operation of products or services provided, such as discovering and dealing with failures of products or services; or 

10) Other circumstances prescribed by laws and regulations

III. How We Provide, Transfer, Publicly Disclose and Have Your Personal Information Processed

3.1 Business sharing

In the following circumstances, we will share your personal information: 

In order to provide higher-quality products and services to you for better customer service and user experience, some of our services will be provided by authorized partners. In such case, please refer to Annex I “List of Personal Information Shared with Third Parties” for the scenarios in which we might transfer and disclose your personal information to third parties and share personal information with such authorized partners and details of relevant personal information processing, although the official website currently does not involve personal information sharing. 

3.2 SDKs shared with third parties

To ensure the realization of certain functions and services provided to you, we will embed third-party SDKs into CHAGEE (Hong Kong) Platforms. Please see Annex II “List of SDKs Shared with Third Parties (Applicable to CHAGEE HK APP” and Annex III “List of SDKs Shared with Third Parties (Applicable to CHAGEE HK WeChat Mini-program”) for information about the purposes, manners and scopes of personal information processed by SDKs, although the official website currently doesn’t involve sharing SDK with third parties. We will share your personal information only for the lawful, legitimate, necessary, specific and definitive purposes, and will only share personal information necessary for service provision. Meanwhile, we will sign stringent non-disclosure agreement with partners, requiring them to process your personal information according to our instructions, this Privacy Policy and any other relevant confidentiality and security measures. If you reject our partners to collect personal information necessary for provision of a service when providing the service, this might result in you being unable to use any services from the third party in our CHAGEE (Hong Kong) Platforms. 

3.3 Assignment of Information 

We will not assign your personal information to any company, organization or individual, except: 

1) With your prior express consent; 

2) Pursuant to laws, regulations or mandatory administrative or judicial requirements; 

3) when M&A, reorganization or bankruptcy liquidation involving asset transfer occurs, if assignment of personal information is involved, we will inform you of relevant circumstances and require the new company or organization in possession of your personal information to continue to be bound by this privacy policy, provided that we will require the company or organization to reacquire your express consent if the purpose of personal information use is changed. 

3.4 Public disclosure 

We will publicly disclose your personal information only in the following circumstances: 

1) Except for displaying the nickname of the prize winner in a de-identified manner when publishing the name list of raffle events, we in principle will not publicly disclose your information. If public disclosure is indeed necessary, we will inform you of the purpose of public disclosure, type of disclosed information and sensitive personal information possibly involved, and obtain your express prior consent; 

2) Law-based disclosure: pursuant to legal proceedings or actions or mandatory requirements of competent authorities, we might publicly disclose your personal information; 

3) As necessary to announce punishments for fraudulent behavior of illegal accounts (only your account nickname will be disclosed). 

Special prompt: as to your personal information publicly disclosed, we will prudently examine its legitimacy, reasonableness and lawfulness within the shortest possible timeframe after receiving the application for public disclosure, and take the most stringent personal information security protection measures and means at the time of and after public disclosure to protect the personal information. 

3.5 Having personal information processed 

To conduct product promotion, increase information processing efficiencies, reduce information processing cost or increase information processing accuracy, we might engage our affiliates or other partners in different jurisdictions to process your information on our behalf. We will require service providers through written agreement or otherwise to process your personal information according to the agreed purpose, manner and scope, and to comply with stringent confidentiality obligations and take effective information security protection measures, prohibiting them from using these information for any other purpose not authorized by us and you. Therefore, your personal information might be transferred to different jurisdictions. 

IV. How We Protect Your Personal Information

4.1 To safeguard your information security, we will save personal information you provided in an appropriate manner after collecting your personal information and subject to compliance with any laws, regulations, rules or accounting provisions, as well as take various reasonable and necessary measures to protect your personal information. 

4.2 We are committed to using various security technologies and supporting management systems to minimize the risk that your information might be leaked, destroyed, misused, accessed or disclosed or changed without authorization, for example, encrypted transmission through network security layer software, encrypted information storage and rigorous control over access to data center. When transferring and storing sensitive personal information, we will take security measures such as encryption, access control and de-identification. 

4.3 We set up information security department for compliance management with respect to collection, use, sharing and processing of personal information. Meanwhile, we adopted appropriate technical measures and organizational setup (including encryption classification and access management) in order to protect your personal information security, as well as conduct training and audit on a regular basis to ensure specialized and duly qualified jobs and personnel protect your personal information. 

4.4 We will take any reasonable and workable measures to ensure irrelevant personal information will not be collected. We will retain your personal information only within such a period as necessary to achieve the purposes set forth herein, unless extending retention periods is allowed by laws and regulations. 

4.5 The internet is not an absolutely secure environment. Therefore, we strongly suggest you take active measures to protect the security of personal information, including but not limited to using complicated passwords, changing passports periodically and not divulging your personal information such as account password to others. If you found your personal information especially your account or password leaked, please immediately contact the customer service in order for us to take corresponding measures according to your request. 

4.6 After you terminate your use of our services, we will cease to collect and use your personal information, except as otherwise prescribed by laws and regulations or regulatory authorities. If we cease to serve or operate, we will notify you at least 30 days in advance, and delete or de-identify your personal information upon our cessation of service or operation. 

4.7 In the unfortunate case of a personal information security incident, we will promptly inform you of the following in compliance with legal and regulatory provisions and requirements of government regulation: the basic details and possible effects of the security incident, disposition measures we already took or will take, your suggestions to prevent and reduce risks by yourself, and remedial measures to you, etc, in which case we will promptly inform you of relevant details of the incident via mail, email, phone call or otherwise, provided that we will issue announcements in a reasonable and effective manner when it’s difficult to inform personal information subjects one by one. Meanwhile, we will also proactively report details of response to the personal information security incident according to requirements of relevant regulatory authorities, while complying with legal and regulatory provisions. 

4.8 Just like the issue that all companies might face, considering the characteristics of information technology and cyberspace itself, in certain special circumstances (such as hacker attack and telecom failure), although we took necessary measures prescribed by laws and regulations, there still exists the risk of personal information leakage. Unless as otherwise provided for in this Privacy Policy to protect your personal or property safety, we specifically remind you not to provide any sensitive personal information involving your personal or property safety such as property condition, health and physiology, account password or verification code and communication content to us or any third party providing services to you in our name through the public network. 

V. Your Rights 

We highly value your concern about personal information and make every possible effort to protect your rights and interests in access, correction, deletion and withdrawal of consent to and of your personal information, in order for you to have sufficient ability to safeguard your privacy and security. Your rights include:

5.1.1.2 You can view, correct and supplement your receiving information (including the ship-to address, and name and telephone number of consignee) via the following paths:

If you cannot view such personal information via the aforesaid paths or want to view, correct and supplement other personal information, you can contact us according to Article 8 “Contact Us” of this policy, and we will reply to your access request within 15 working days. 

5.1.2 As to difficulties encountered by you in the process of exercising the aforesaid rights or in other circumstances where providing services of online self correction/modification to you might be impossible at present, through verification of your identity and provided that the correction/modification will not affect the objectivity and accuracy of information, you have the right to correct or modify erroneous or incomplete information, or in particular circumstances, especially when data is erroneous, to submit your request for correction/modification to us through the feedback, error reporting or other measures published by us, requiring us to correct or modify your data, except as otherwise prescribed by laws and regulations. Out of consideration for security and identification or due to technical means, you might be unable to modify certain initial registration information submitted at the time of registration (such as the user ID automatically generated by the system after your registration), which information is not information displayed externally and will not affect your use in any manner, in which case we may delete your account, allowing you to modify your information through reregistering an account, but it should be noted that by doing so you will lose any and all information in the original account. 

5.2 Deleting your personal information 

You can submit a request for deleting personal information to us through the contact details set forth in Article 8 “Contact Us” of this Privacy Policy. 

When we receive your request for deletion, we will notify persons who have received your personal information from us as far as possible at the same time, requiring them to delete promptly, unless as otherwise prescribed by laws and regulations or these persons have obtained your independent authorization. 

After you delete or we assist you in deleting the information from our services, according to relevant laws and regulations, we might not immediately delete the corresponding information from backup systems, and will securely store your personal information and isolate them from any further processing until backups can be deleted or de-identified. 

5.3 Cancelling your account 

1) If you need to cancel your account, you can apply for cancellation by logging into CHAGEE HK APP-clicking “my”-clicking “permission settings”-“cancel an account” or CHAGEE HK WeChat Mini-program- clicking “my”-clicking “account name”-entering into “personal data”-clicking “account and security”; you can also apply for cancellation by submitting an email to customercare_hk@chagee.com. 

2) Please particularly note that the manner in which you cancel your account and the conditions to be satisfied by you are detailed in Annex IV “Instructions on Cancellation of CHAGEE HK user Accounts” to this Privacy Policy. After you cancel your account, we will cease to provide any products and/or services to you and we will delete or de-identify your personal information upon your request, except as otherwise prescribed by laws and regulations. 

5.4 Withdrawing your consent to personal information 

Part of functions of products and services we provide require relevant permissions of yours to use devices (including location and album, etc, subject to functions actually acquired by products), and you can withdraw (stop) continued authorizations to such permissions at any time after the authorization. You can change the scope of your authorization granted for our continued collection of personal information or withdraw your authorization by deleting information, changing the privacy settings, disabling device permissions function in the system or otherwise. The specific method for doing so is as follows: applying for withdrawal of your authorization by submitting an email to customercare_hk@chagee.com.

Of course, you can also withdraw any and all of your authorizations for our continued collection of your personal information by choosing to cancel your account. You need to understand that after you withdraw your authorizations, we will be unable to continue providing the specific functions and/or services corresponding to authorizations to you, but your decision to withdraw your authorizations will not affect the previous personal information processing conducted based on your authorization. 

5.5 Responding to your other claims

5.5.1 If you need to but cannot view, correct or delete your personal information in the aforesaid manners, or you need to view, correct or delete other personal information generated when you are using our products and/or services, or you need to exercise other rights you have to personal information under relevant laws and regulations (such as requesting copies regarding your personal data), you can contact us using the contact details set forth in Article 8 “Contact Us” of this Privacy Policy. 

To ensure security, we might need you to provide a written request or otherwise prove your identity, and we will reply to your request within 30 days of receiving your feedback and verification of your identity. We might reject any request that is repeated without justifiable reasons, requires the use of excessive technical means (e.g., requiring development of new systems or fundamental change to current practice) or poses risks to others’ legitimate rights and interests or is highly unrealistic. 

5.5.2 In the following circumstances, we will be unable to respond to your request according to legal and regulatory requirements: 

1) Pursuant to requirements of all relevant laws or court orders or of other governments or law enforcement agencies;

2) In connection with public security, public health or significant public interests; 

3) In connection with crime investigation, legal action, trial or execution of judgments;

4) To establish legal appeals or defense or acquire legal opinion;

5) Where there is sufficient evidence that the personal information subject has subjective malice or abused rights; 

6) Where responding to your request will result in your or other individuals or organizations’ legitimate rights and interest being seriously damaged; 

7) Where business secrets are involved; or 

8) Other circumstances prescribed by laws and regulations. 

VI. How We Store Your Personal Information

6.1 Place of information storage 

6.1.1 Our services are global, such that information might be stored and processed in countries/regions in which our business is operated and countries/regions in which we cooperate with service providers according to requirements of applicable law when necessary (including access from other jurisdictions). You are aware and confirm that the aforesaid processing activities we conduct on your personal information are processing activities necessary to provide services to you, and you might be unable to use all of our functions if you disallow us to store and process your personal information in the aforesaid manners. 

6.1.2 We will conduct the aforesaid cross-border transmission of personal information strictly in compliance with requirements of the Personal Data (Privacy) Ordinance (Cap. 486), subject to acquisition of your consent or existence of other basis of legitimacy. You can contact us to know the names and contact details of relevant overseas partners, purposes and manners of processing, types of personal information and the manners and procedures with which you exercise personal information rights through the guide set forth in Article 8 of this Privacy Policy. We will evaluate the lawfulness, legitimacy and necessity of cross-border transmission of personal information according to requirements of the Personal Data (Privacy) Ordinance (Cap. 486), and supervise and urge our overseas partners to process personal information you provided according to the Personal Data (Privacy) Ordinance (Cap. 486) and provisions of relevant agreements. These jurisdictions might have different information protection rules than those of Hong Kong, including transmitting information to regulatory authorities or to employees operating outside of Hong Kong and processing information on behalf of us or our suppliers, who might be engaged in business of performing your requests and providing support services. However, we will take measures to ensure any such transmission complies with applicable information protection laws and ensure that information protection provided to you complies with the standards described herein. By submitting any information, you agree to share, store or process the information. We will take any and all reasonable and necessary steps to ensure information is processed securely and in compliance with this Privacy Policy and relevant information protection provisions. 

6.1.3 We will retain your personal information only within such a period as necessary to achieve the purposes set forth in this Privacy Policy. We will strictly carry out the principle of minimum and necessary storage period for your personal information, for example, storing your personal information for at least five years after the end of business relationship according to requirements of anti-money laundering laws and regulations. If relevant data is no longer necessary to be stored or used and subject to legal restrictions, we will promptly take measures of data deletion or de-identification. 

6.2 Period of information storage 

6.2.1 Our retention period for your personal information is the minimum time necessary to achieve relevant purposes of processing. Generally, we continuously store your personal information during your use of CHAGEE (Hong Kong) Platforms’ services, and will delete or de-identify your personal information upon your cancellation of your account, but if AML laws and regulations require us to store your personal information for at least five years after the end of the business relationship, we will store in strict compliance with such minimum and necessary principles. If relevant data is no longer necessary to be stored or used and subject to legal restrictions, we will promptly take measures of data deletion or de-identification. 

6.2.2 When our products or services cease to be operated, we will notify you in advance in the form of push notification and announcement and delete or de-identify your personal information upon cessation of operations. 

VII. How We Protect Personal Information of Minors

7.1 Since we identify CHAGEE HK users only by means of mobile number, and do not collect any of your information related to ID, we are unable to distinguish whether a user is a minor. If you are a minor as defined in your jurisdiction, before using CHAGEE (Hong Kong) Platforms, please be sure to ask your guardian to carefully read the terms of this Privacy Policy, and not to use any of CHAGEE (Hong Kong) Platforms or provide your personal information to us until after you obtain your guardian’s consent. If your guardian disagrees with your use of our CHAGEE (Hong Kong) Platforms according to terms of this Privacy Policy, or you found we are involved in collection of personal information of minors, please immediately cease to use our services or promptly notify us in order for us to take the corresponding measures, including but not limited to deletion of your personal information. As to the age limit of minors, we will follow the norms in your jurisdiction and adjust it as and when the laws change. 

7.2 If you are the guardian of a minor, when you have any doubt about the personal information of the minor under your guardianship, please contact us using the contact details published in the terms of this policy in order for us to take corresponding measures in a timely manner. 

7.3 If any of CHAGEE (Hong Kong) Platforms involves providing services to any minor under specific functions, we will remind the relevant guardians to carefully read this Privacy Policy and our other notification texts when signing up for any events or purchasing such services for their minors, on the premise that by signing up for or purchasing such services of their own accord, those guardians expressly consent to our collection and use of personal information of relevant minors.

IX. How This Privacy Policy Will Be Updated

In order to provide better services to you, we will make updates to this Privacy Policy according to the updates of CHAGEE (Hong Kong) Platforms and relevant requirements of laws and regulations, which shall constitute part of this Privacy Policy. We will remind you of updates to relevant contents by issuing updated versions on the websites and mobile clients of CHAGEE (Hong Kong) Platforms and through announcement, pop-up window prompt or other appropriate manners before their entry into effect, yet we also request you to visit CHAGEE (Hong Kong) mobile clients in order to keep informed of the latest privacy policy. 

We will not impair the rights that you are entitled to according to this Privacy Policy without your express instructions. By continuing using our services after this Privacy Policy is updated and takes effect, you fully read, understand and agree to be bound by this Privacy Policy as revised. If you don’t accept the updated privacy policy, please immediately cease to use any of services we provide. 

X. Dispute Resolution 

10.1 Any person other than you and CHAGEE HK has no right under the Contracts (Rights of Third Parties) Ordinance (Cap. 623) to enforce any provisions of this Privacy Policy and relevant annexes or enjoy the benefits of this Privacy Policy and relevant annexes. 

10.2 This Privacy Policy is written in simple Chinese , traditional Chinese and English. In the event of any ambiguity or conflict between the Chinese and English versions of this Agreement, the interpretation and expression of the Chinese version shall prevail.

10.3 The interpretation and dispute resolution of this Privacy Policy shall be governed by the laws of Hong Kong Special Administrative Region of China, and the Hong Kong courts have the exclusive jurisdiction over any disputes arising from this Privacy Policy and relevant annexes. 

10.4 If you believe our act of processing of personal information has jeopardized your legitimate rights and interests, you may also choose to report to the local government departments in Hong Kong of China.

Dear user: 

We hereby remind you in good faith that your act of account cancellation will bring numerous inconveniences to your warranty claims, and after cancelling your CHAGEE HK user account, your personal information will be removed by us from the frontend system of CHAGEE HK to keep it unsearchable and inaccessible or be de-identified. You know and understand that relevant transaction records must be kept at the backend of CHAGEE HK for 5 years or even longer according to AML and other relevant laws and regulations. 

1. If you still decide to cancel your account, your account is required to satisfy the following conditions at the same time: 

(1)There is no balance of prepaid cards available or any coupon package purchased but not yet used up in the account;

(2)There is no asset or virtual entitlements within the account and you ensure there are no arrears in the account;

(3)There is no outstanding order (including bonus point orders, etc) or service in the account; 

(4)The account is free of any disputes, including complaints or reports from or against the account; 

(5)The account is currently active and free of some records of account restriction. 

2. You are aware and agree that your CHAGEE HK user account will not be restored once cancelled, so please back up any and all information and data related to your CHAGEE HK user account before acting. Please properly keep transaction vouchers, bills and other data regarding ordered goods and services, or otherwise you might be required to pay extra account and order query fees or become unable to enjoy after-sales services. 

3. If your CHAGEE HK user account is involved in disputes, including but not limited to complaints, whistle-blowing, litigation, arbitration and investigation by national competent authorities, we have the right to terminate the cancellation of CHAGEE HK user account without your further consent. 

4. After you complete the confirmation procedure for cancellation of your CHAGEE HK user account, we will synchronously cease to provide you with the services set forth in the Terms and Conditions (“User Agreement”), services in other policies or rules issued by us, services and tasks published by our policies, rules and regulations and by third-party platforms through CHAGEE HK, and the rights and obligations of both parties set forth in the User Agreement, policies, rules and regulations and services and tasks published by third-party platforms through CHAGEE (Hong Kong) Platforms will all be terminated after you complete the cancellation procedure (except for those which may not be terminated or by their nature cannot be terminated as otherwise set forth in terms such as the User Agreement, policies, rules and regulations). Your account will be cancelled synchronously and you will be unable to further use your CHAGEE HK user account or retrieve any contents or information in or in connection with your CHAGEE HK user account, including but not limited to that: 

(1)You will be unable to log into or use your CHAGEE HK user account or log into any service portal of each CHAGEE HK platform;

(2)Your personal data and historical information in or with respect to your CHAGEE HK user account (including but not limited to nickname, avatar and shopping records) will all be cleared and cannot be retrieved anymore; 

(3)The relevant account entitlements you once received (including but not limited to user bonus points and user grade) will be deemed to have been waived by yourself and will no longer be available. 

You understand and agree that we cannot assist you in restoring the aforesaid services. Please be sure to learn about relevant account information you are required to unbundle before submitting an application for cancellation, by consulting us according to the contact details we published. 

5. You are aware and agree that your act of cancellation of CHAGEE HK user account does not mean any waiver or alleviation of your account behavior or relevant responsibilities or liabilities arising before cancellation of your CHAGEE HK user account. 

6. You are aware and agree that in order to ensure your account and information can be cancelled properly in compliance with regulations, we will need to expend certain time, i.e., 15 days, you being unable to reregister using the same account registration information, while you may also contact our customer service for resolution if you want to restore your CHAGEE HK user account during that period. 

7. These “Cancellation Instructions” constitute a supplement to the Terms and Conditions and the Privacy Policy. 

8. These “Cancellation Instructions” shall take effect on the day when published and applicable and remain valid until the publication of an updated version. 

9 We have the right to interpret and modify these “Cancellation Instructions” to the fullest extent allowed by law. 

10. To better serve you, we have the right to change these “Cancellation Instructions” in light of our operational realities and necessity, effective as of entry into effect thereof, and you can view the terms of these “Cancellation Instructions” of the latest version on the relevant pages of CHAGEE HK. 

11. By clicking the “Confirm” button beneath this agreement, you fully accept these “Cancellation Instructions” and perform the cancellation process, so before clicking, please once again confirm that you have known and fully understood any and all contents of these cancellation instructions.
